GENERAL INFORMATION, TERMS AND CONDITIONS
Liability and Responsibility– Each Guest should read carefully the following conditions. Making a reservation shall be deemed the Guest’s consent to the terms and conditions outlined below.
VIP Cruise, Tours & Events, LLC at 1069 W. Broad St., Suite #803 Falls Church, VA 22046, including any of its owners, agents, representatives, associates, or employees, hereafter known as the Travel Agency, acts solely as an agent for the Guest. All services, including but not limited to hotel accommodations, restaurants, shore excursions, water sports equipment, ground transportation and cruise transportation are provided by independent contractors. They do not act for, or on behalf of, or as agents of, or in joint ventures with, the Travel Agency. The Travel Agency has no responsibility whatsoever in whole or part for any occurrences including but not limited to any delay, loss, accidents, personal injury, sickness, medical expenses or property damage occasioned by fault or negligence of any person, employee or company entrusted with the performance of such service from whatever cause. The Travel Agency has no responsibility for the loss of, or damage to Guest’s luggage, money, jewelry, valuables, or any other belongings whatsoever and howsoever caused. The Travel Agency expressly disclaims any and all liability for Guest’s damages for emotional distress, mental suffering or psychological injury of any kind, under any circumstances whatsoever. The Travel Agency has no responsibility whatsoever in whole or part and the Guest agrees to hold Travel Agency harmless for any and all liability or claims for any occurrences including but not limited to any delay, loss, accidents, personally injury, sickness, medical expenses or property damage occasioned by VIP Cruise, Tours & Events, LLC, including any of its owners, agents, representatives, associates, or employees, to the extent permitted by Virginia law.
Certifications and Acknowledgements– By making a reservation as a Guest, I certify that I am in good health, I am able-bodied, and I will manage my own person without requiring the assistance of any others in all aspects of traveling with the Travel Agency, including being responsible for my own baggage when traveling, boarding and disembarking the cruise ship or any other mode of transportation we may use. I acknowledge that it is my personal responsibility to be on the airplane, cruise ship, or any other required mode of transportation by the designated time. If I fail to appear in a timely manner, I acknowledge I will bear all expenses incurred by me and hold the Travel Agency, its principals, agent, and employees, harmless from all liability therefore. I acknowledge I am responsible for all passports, visas, and other travel documents required for my travel with the Travel Agency, including those required for air travel, embarkation and disembarkation of the cruise ship, and at all ports of call. I also agree to obey all rules and instructions issued by the leaders designated by the Travel Agency in preparation for and during the trip.
Cancellation or Changes- If, because of loss or damage to the ship, or need to repair the ship, or any other cause beyond the reasonable control of the Travel Agency, the ship is unavailable, the Travel Agency shall have the right to cancel the cruise event and refund all monies to the guests without interest pertaining to the cruise. Such refund shall be the Travel Agency’s only responsibility.The same reserved right by the Travel Agency also allows it to make any changes, including itineraries, schedules, programs and hosts, which could become necessary with or without notice. The Travel Agency reserves the right to accept or decline any person as a member of the tour group or cruise at any time.
For Guests Who Request Roommate Matching- Your decision to accept a roommate for the cruise is at your own risk. Travel Agency is not responsible nor liable for any and all claims or cause of action arising out of or in connection with your selection of a roommate for the Cruise, including, without limitation, any injury, loss or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from such request or selection.
Disputes and Claims- Any claim or dispute by the Guest with the Travel Agency arising out of or relating to this contract or services pursuant to this contract shall be settled by binding arbitration in accordance with the rules then in effect adopted by the American Arbitration Association, which arbitration shall take place in the Commonwealth of Virginia, applying Virginia law, without regard to conflicts of laws provisions. A request for arbitration must be filed within six months from the Guest’s scheduled departure date.
Media/Photographic/Video Release- Guest agrees to participate in promotional, publicity, or merchandising photos of The Agency’s guests during this event. The Guest hereby authorizes the reproduction, sale, copyright, broadcast and/or distribution of said media forms, sound recordings and pictures without limitations. The Guest further agrees and releases the Travel Agency, their representatives and agents from any liability, loss, expense or claims arising from distribution, broadcast, sale or use of his/her likeness or voice.
Payment/Cancellation Policy Per Person– The Travel Agency reserves the right to cancel any Guest for non-compliance with this payment schedule and the cancellation fee will be charged according to this cancellation policy. No name changes can be permitted within 100 days of departure.

NOTICE: Cancellation Fee is calculated Per Cabin. You receive a refund if Travel Agency receives your written notice of cancellation at least 100 days prior to departure, minus a $100 processing fee per person. You receive no refund from Travel Agency for notice less than 100 days prior to the departure. Trip cancellation insurance is required. It provides refund in case of trip cancellation due to illness of self, a traveling companion or immediate family. It includes medical and evacuation coverage, as well as reimbursement for baggage loss or delay. Pre-existing medical conditions are excluded; other restrictions apply. Refund does not include Travel Agency’s commission (approx. 10% of total package price), nor cost of insurance policy itself. Please note: Medicare and Medicaid are not accepted for payment on board ship or when traveling abroad. If cancellation is a last minute emergency it is the responsibility of the guest to notify the travel agency by telephone before the ship sails from its departure city. A no-show at the pier is not covered.
I have read, understand and agree to the terms and conditions, liability, responsibility, payment schedules, deposit policy, cancellation policy, and video/photographic release as written on both of these pages. I understand this reservation request form becomes a contract by the Travel Agency with my initial deposit.This contract represents the entire agreement of the parties hereto, and cannot be modified by oral statements or electronic communications such as email. This contract is enforceable under the laws of the Commonwealth of Virginia. Should any provision of this contract be deemed unenforceable for any reason, it shall be severable from the remaining provisions of the contract, and such severance shall have no effect upon the remaining provisions of the contract, which shall remain enforceable in full. If the Guest(s), fails to meet the outlined deposit/payment schedule, the Travel Agency reserves the right to cancel this reservation and assess the cancellation fee as outlined above. I also acknowledge that cruise itineraries and schedules are subject to change without notice.
